Wow. I'm saddened and disgusted by many posts ITT. I'm not really surprised though. You can't kill people for stealing. You cannot kill them for burglary. The story itself is fishy as hell. Even the shooters account is murder 2 on the guy, and murder 1 on the girl.

You are allowed to use a firearm in your home to defend yourself from a threat. If you shoot that threat and render them no longer a threat coming up short of killing them then you "finish them off" you just committed murder. If you shoot or otherwise kill someone in your home that a reasonable sane person would deem not a threat, you committed murder. If someone breaks into your home, you point a gun at them, they put up their hands and kneel down asking you not to shoot and you walk over to them and blow their brains out you just committed murder. If there is a witness to this you will fry. And should.

No, its not. If your in your home you can simply wait till they come in while hiding if you choose. What else are you supposed to do, ask them to please go away? Run out your back door? No.
But you cant deliver a "finishing shot".

So - if my home is invaded and I gather up my family and we hide in a bedroom and the robbers come thru the door and I eliminate the threat I'm laying in wait and that's illegal.

I don't think so.

And if it is then what the hell is the purpose of the OK SDA and how it addresses those who illegally enter one's home.

Must one seek out the invader?

Wolfie, I don't think that is what he is saying. I think he means that you cannot just wait around to ambush someone and kill them. So for example, if yopu had a lake house that was getting broken into regularly, you can't just hide yourself out there and dry gultch the offenders. I think you could hide out there and catch them and if they drew a gun or were a deadly threat, nature would take its course. Same way you cannot make booby traps.

Y'all need to go back and watch some old episodes of Gunsmoke. Even those old west yokels who had shootouts every day knew where the line was drawn.
