At what point does an individual stop selling "personal" firearms and become a "dealer" thus requiring an FFL? Two a week? Five a week? I see some of the same people selling a lot of black rifles with no 4473 requirement. I have always wondered at what point are you required to get an FFL.

The ATF decides arbitrarily on a case by case basis based on their precise judgement. It's all based on perception with them. If you look like a duck they're going to treat you like a duck.

What dustin said, but a good rule of thumb is, if you are making more money selling firearms, than you are making at your job, you're a dealer.

don't ask, don't tell. seriously though.ffl holders may have a legitimate gripe. we all sell guns. some we sell for profit, some we may take a loss on. there is no specified law as to how many you can sell like there is for cars if thats what you're getting at. maybe there is,i don't know
