well if someone is buying a firearm from a dealer and paying dealer price (profit + taxes) that would be a consumer. If that consumer later sells said firearm at cost, or trades, or even makes a profit due to the current environment why would they need a FFL? I would assume one would need a FFL to get guns at wholesale not close to retail....

That brings up a good point too... I'm sure everyone who sells private guns for profit is paying taxes on them too. All you have to do is pay taxes and then the ATF will leave you alone.

....even if I make a profit its hard to prove that I am intending to do it as a business.

The scary part is, once charges are filed you'd have to prove your innocence. That bit about "innocent until proven guilty" only applies to people who have enough money to lawyer up and win. They have the full weight of the United States government behind them.

I dont think you read that right HMFIC.

OH no, Dr. HK is right, you can't consider a private citizen who just sells one gun a dealer, but it just brought to mind the whole point of taxes for those who do it on a regular basis and engage in the purchasing and selling of firearms for the purpose of profit.

I'm betting that as long as you pay taxes on the income you gain from selling private guns on a regular basis, that the ATF would leave you alone. You know... cuz you're paying taxes and all and being legal, right?
