I do believe that even if there is no magazine and the slide is not locked back that is also considered a loaded firearm. If the cylinder on a revolver is not open it is considered a loaded firearm.

This would be troublesome for some smaller handguns I've owned that do not have the capability to lock the slide back.

OK I am no expert or any thing how ever I did stay at holiday inn express once. First off a gun in a tackle box, that my friend is a concealed weapon if the box is closed, a case could be made that it was still concealed even if it was opened. If he had a concealed weapon license there shouldn't be a problem.
second, Never Ever Mix Alcohol and Firearms (Period)
He needs to show more response ability when having a firearm in his possession.
Third. Friends with warrants?
