Yes the argument could be made for that as well. It would just depend on how hard the DA wanted to push the issue, and stress the laws as they are written. Could say that since the perp was fleeing they were no longer a threat to the safety of her or her family. Last time I heard, there is a OKC Pharmacist that is finding this out the hard way. Would not be much of a stretch for the DA to make the same type of argument here.

Video is the unbiased witness. Unfortunate for the Pharmacist.

No video here as far as I know and I am pretty sure a Jury of Peers with a descent Lawyer will be able to name the mother as fearing for her life and the life of her children, no doubt.

I wouldn't have shot after he fled personally, but I can see a mother repeating her actions in the same scenario.

I say, thank God she had a gun and the guts to use it. I hate to think what would have happend in that home when two masked individuals entered and found a single woman and 4 kids. It could have been really bad. GO MOM! My wife knows where the loaded guns are and how to access them. Shes been to the range with me a few times, I just hope that she would have the courage to use one if needed.

Now she has to worry about the sack of **** and maybe a friend or two coming back. Not a good situation,but good for her for 'standing her ground'.

So let me get this perfectly straight,(at my home in California and in Iowa I live outside the city limits and in Oklahoma Im just barely inside the city limits),in the city limits in Oklahoma,defense of your self and family on your property from a person(s) with a weapon(s) that are threatening your life/lives,defense with a firearm is limited to just the inside of your house? I know Ive heard and read it a million times,just clarifying. Ive been told before also a million times,and I never took it serious, that if you do shoot them outside your house,on the porch,in the yard,etc to 'drag them back inside your house' (of all people a cop told me this bit of advice once...). But,your yard- front or back- vehicles in the driveway,etcetc,its all off limits? In the midst of a gun fight inside your home the BG flees out the door,and then thats it,gunfight is over,dont try and chase them down,just get on the phone and get the cops there if someone hasnt already called them? Got it. Now,as a CC permit holder, if I pulled into my driveway and was getting out of my car in my driveway and someone pulls a gun on me in my driveway or shoots at me in my driveway,I can return fire? Its all a bit confusing.

Well considering that the burglar not only broke into her home, occupied by minor children and one adult, but the guy also fired back in to the home. This woman should and will be in the clear.
