Well, that's an interesting question. What does it say? How do you read it?

Begin with this: what is the fundamental right guaranteed (not conferred) by the Fourth Amendment? What is its essence?

It's really a simple question and can be answered with either "Yes" or "No". If you believe there is any possible circumstance where a warrant wouldn't be needed prior to the police/government searching/seizing something, the answer would be "No". Otherwise it's a "Yes".

Sure, but such belief has to be predicated on the Fourth Amendment itself. It's not difficult. If unsupported by the text, as you seem to be asking, it's merely a gratuitous opinion. If supported, we have substantive material to discuss.

I'm gonna go out on a limb and say the car was never "torn apart", the "clock" isn't running on anyone putting it back together, and there was more to the story than he's letting on.

F**k it... It's no longer a decent conversation...it's some random dude trying justify his opinions.

Yeah, wonder if his kid is even pushing for this… I bet not. Makes no sense to persue unless the car was trashed. If it was trashed, you would have the photos for evidence…
