What I took from Huckabee is simply we have been turning from God in most aspects of life, and when something bad happens we seem to turn back to God for comfort. If we raise our kids away from God I guess we shouldn't think that they will grow up Godly. I pretty much agree with what he was implying but I also think that there is a lot of bad influence around our kids these days like to much killing in movies and video games. Just my take on what Huckabee said.

I completely and totally despise the WBC freaks.

There is one interesting thing though that always happens when they pull one of their blackmail / attention capers is the debate on the 1st Amendment. What I find encouraging is no matter how much I and many others would really love to be able to stifle their vile blathering, millions and millions of Americans always stand up to protect the right to unabridged free speech. I only wish that those same Americans would also fight as hard and without giving an inch of ground when it comes to the 2nd Amendment as well.

You are very right.

So...what about:

There are certain well-defined and narrowly limited classes of speech, the prevention and punishment of which have never been thought to raise any constitutional problem. These include the lewd and obscene, the profane, the libelous, and the insulting or "fighting words" those that by their very utterance inflict injury or tend to incite an immediate breach of the peace. It has been well observed that such utterances are no essential part of any exposition of ideas, and are of such slight social value as a step to truth that any benefit that may be derived from them is clearly outweighed by the social interest in order and morality.

- Chaplinsky v. New Hampshire, 1942

Edit: I guess Snyder v. Phelps limited "fighting words" significantly, especially since it was the WBC case. But it also upheld the local statutes and ordinances that limit the protesting times at funerals.

Ans still, it seems to me if they REALLY got ugly, they can still be arrested for incitement, no?

That's exactly what they want, so they can sue. They'll sue if not given 1st Amendment protections. They'll sue if not adequately protected by local authorities. Pretty much their entire goal is to sue someone for something.

Right, but they'd have to sue locally in the jurisdiction that arrested them for incitement or violation of the local interpretation of the aforementioned protective ordinances, no?
