I need a little legal advice maybe

Okay so i know there is some lawyers and people in the legal field here. Let me explain why i want legal advice.

Back in May and June I loaned a lady friend money to make two car payments and then some weeks later i paid her phone bill. These three things totaled $400. She said she'd pay me back but i havent seen one cent of the money yet. I have dates and amounts that i gave her and i know the money went to tmobile and a car dealership in pryor..........as far as I know. Now i've been asking her if she can pay me back and she keeps giving me the runaround. Legally what can I do to recoup my money if she doesnt pay me? I dont want to get too harrassing or anything, I just want my money and she can go on her merry way

Was it a check? Or cash? I am not a lawyer, but I think it will be something they will ask. If it was cash, probably an expensive lesson learned.

Yeap!! If you didn't write "LOAN" on the check then you can start thinking about kissing your cash bye bye. Unless she says "Yes your Honor he did loan me the cash" in small claims court. Good Luck!!!

ALWAYS consider money to someone else a gift. If your brain says I don't want to give this person $400 then don't "loan" it to them. I think I read that somewhere. Of course that is not going to help you now. Sorry.
But that's just me.

I don't know about Oklahoma, but in Kansas that what's called a "civil issue", which means that you would have to go through small claims court. Small claims court is up to, but not over, $1000 with no lawyers or anything like that. Basically you file with the county and they set up a court date for you and her. A judge then determines who wins. You pay up front and if she loses, then she pays the costs plus the damages or whatever your claiming.

That.... If you are not willing to lose it, don't loan it.

Sorry about your loss man 400.00 is not a real cheap lesson, but better than a grand or more.

I have several people owe for money I "loaned" them. In one case it's been 7 years and the amount is $700.
All told, I've probably "loaned" $3500 out to friends in the last 10 years.
It's about 50/50 whether I get paid back or not most of the time.
If they still owe me and made no effort to pay me back, I never give them a second chance.
I think you'll probably never see that cash again.
Write it off as a tax deduction and go on.
