True there is not a jury instruction on jury nullification and in fact you take an oath as a juror to uphold the law. The judge will also, tell the jury they are triers of fact.

It's a fact, that some laws are unconstitutional. If you want to apply jury nullification as is your right, you just have to keep your mouth shut and refuse to convict. Jury nullification is an important tool in the justice system. Those who are against it are against anyone contradicting their authority. It has nothing to do with true justice. :disappoin

It may be useful to look at things from the other direction. Is what we have now, jury intimidation? - "You must convict even if you think the law is wrong"

One example of an unjust law that irks me is the use of eminent domain to kick people out of their homes to build college athletic villages.

We aquited a driver, had to do with a u-turn and a red light. The judge was pissed and told us that we obviously conspired against the officer and the law.

I'm sorry, I didn't realize the officer had a personal stake in the outcome of the case (beyond the overtime he got for going to court that is). And what were the specific damages to the law itself? Did he not realize that 12 people in a jury room is by defintion a conspiracy to effect an outcome? Why would the judge be pissed? It's not like he wrote the law. All he's there to do is oversee the process, not take sides! Did he overturn your decision?

Upsetting a judge with my vote on a jury would rank right up there on my concern list with hurting the feelings of a pushy used car salesman.
