I could possibly see in international trade and business agreements/negotiations where where there might be some need for using such a practice. But in other cases I see no need. Even in divorce cases involving US citizens, such things as residency must be established. They must be legal residents in their state where they were married or the separate state where the other person has moved to. Why should Oklahoma have to make ruling for people where one or both are not legal citizens? Shouldn't they have to go back to their country of origin to settle their dispute(s)? And I really cannot abide using international laws to determined Constitutional issues/cases or the laws and regulations that affect the citizens of this country. Using international law for such purposes will only open a Pandora's Box of problems. The United States already has too many laws and regulations that have to be followed without bringing in more to muddy the waters. Some of our laws are already too perplexing/inexplicable enough without adding more international laws to them. I would imagine though that if international laws were allowed to be used in US Courts, this would create a real Bonanza for trial lawyers everywhere. I would think the ABA would really be supportive of such a move that would tie up our legal system and make them extremely rich.

I believe you missed the part about exotic weddings. If you get married in another country, you are married according to the laws of that country. US citizens are married overseas all the time.

This is not about using international law to settle disputes between non-citizens. This is not about using international law to settle Constitutional issues. This is about using international law where it is absolutely appropriate.

If our courts are not allowed that tool and businesses are not allowed to freely negotiate contracts, you will see jobs leave Oklahoma. If our courts are not allowed that tool and a couple chooses to have their dream wedding in another country, that couple might have a pretty difficult time getting divorced later since they may not be legally married if the process in that country did not match the process in Oklahoma.

I'm willing to bet that SQ755 will pass, but it won't pass for the right reasons. It will pass because of fear and xenophobia. Anyone who votes yes on it is actively participating in limiting the ability of the legal system in the State of Oklahoma to protect the citizens of Oklahoma.
