So, I have to work with this stoner piece of crap. He vapes thc all day long. He's caused me to get injured, he's injured himself, and he damages product frequently. He's also rude to customers. And his most common retort to anything is...I don't gaf. I've complained for 4 years now, and the company won't do anything about it. He lives right around the block, and shows up for work every day. I guess that's all they care about.

So... I'm fed up. Aside from catching him after work and putting him in the hospital, and myself in jail, what recourse do I have? Aren't I supposed to have some legal protections against being forced to work with someone who's always intoxicated?

Call the local PD and have them wait outside for him to show up for work and have him arrested for DUI. Even if he has a med MJ card, he can't operate a motor vehicle under the influence of pot. This may just be a temporary fix, but if it becomes a habit, maybe your boss will take notice as well as action.

On the flip side...he is a warm body, showing up for work every day. That's quite an accomplishment considering today's generation.

And your employer is required to provide a safe work environment. Did injuries get involvement from OSHA? Lost work? Have you documented? DUI in company vehicle is bad. Have the customer’s complained or refused him access to their property? Can you switch jobs? What type of work? Is it a big company with deep pockets?

If someone subcontracting on one of my projects showed up with people under the influence the owner and or senior most manager would be called on the floor by me. I have sent companies away and cost them money for such idiocy. When we say safety and security we are NOT messing around.

Sounds like your only real options are quit the job and get an attorney. If you want to go the legal route be sure to write management about it several times. Document everything you can. Raise hell for your safety. Get fired. Then lawyer.

The only thing he drives is a bicycle.

It's a cabinet shop. Most days I don't have to work with him. It's only when we have to go on deliveries together that the problems really arise. We lost our delivery driver, and I'm the only other person in the shop that can handle the truck/trailer. He's the only other person in the shop physically capable of picking up and carrying the necessary weight.

Frankly, I wish he'd just go ahead and hurt himself badly enough that he can't work for awhile.
