not sure if iam posting in the right thread but here goes ok so my cusin wants to go buy a gun for hunting next year but he doesnt know if he will pass the nics check he had a vpo agianst him ended as of 24 nov is he eligible to purchase a firearm he says he doesnt want to go try and buy one and be embarised if he doesnt pass he has talked to a lawyer didnt get any real answers tried calling the atf never got a call back any help would be appreciated

Don't be a nice guy and buy it for him. Repeat: Don't do it.

He has plenty of time before next season to get this worked out. He needs to stay completely within the law on this one. Somebody will eventually help him, but he needs to persist.

VPOs handed out like candy? Not sure I agree with that. If it was baseless, lots of attorneys would take such a case on contingency. Plenty of precedent for sueing entities that go overboard, and a simple letter signed by a savvy attorney can sometimes get such things expunged. Governments don't like lawsuits, and this sounds like one agency may be open to one.

lol he is a good guy just was with a crazy ***** and they hand vpos out like candy
+1000. If RO's kept someone from buying a gun I wouldnt own any. Anytime my ex-wife wanted me out of the house so she could party and runaround all she had to do was call the cops and tell a good story. If the officer was nice he would let me get some clothes and a few things. If not I went to the cockroach inn with the clothes on my back. My stupidity for trying to make it work as long as I did but I eventually wised up and now am divorced with custody of my kids.

Oh and tell your cousin not to worry. It's not going to keep him from getting to purchase a gun. Best time to purchase is middle of the day when the ATF isn't flooded with checks. Buy on a weekend get delayed, buy on a weekday, takes ten minutes.

Have him give it a try. Worst case scenario, he'll probably have to wait a couple of days for the OK.

Worst case scenario is a denial. Question 11h is the issue.

Instructions on 11h says "subject to . . .") If the order was lifted, my non legal opinion is that he shouldn't be denied. However, it depends on whether the ATF has received info on the restraining order, and (less likely this soon), received notice that it was lifted.

I'd say he should try it. As I read the instructions, he is not required to say "yes," because he isn't.
