"Exigent Circumstances" will be whatever the judge presiding over the case says they will be. They could've just as easily set up on the roof with a sniper and spotter. However, the case for the police would've been much stronger had they stated they were removing occupants for their safety, as opposed to gaining a "tactical advantage". I don't like the precedent this will set if they side with LE. The circumstances on the ground may have warranted the intrusion, but the precedent will be misused at some point if set. :(

I cannot fathom how you all could not see that these fine and upstanding officers of the law were merely protecting the citizen from their self. It was imperative that the occupant cease legally residing in his home and since that individual didn't have the common sense to do so who knows what else they are capable of. It is a good thing they shot the dog also, I know they were just trying to protect the owner from getting attacked by its own dog.

These fine officers of the law deserve an accommodation for using the best judgement, putting a law abiding citizens safety and rights first and for just being all around studs of the police force. These men are mother f****n HERO's.

By choosing to become militarized, police departments and other law enforcement agencies have arguably chosen to be treated as soldiers, especially give the "us vs. civilians" mindset seen frequently in the press.

But what is the definition of quartering? Does it depend on length of stay? Actual or anticipated?

And if I'm reading this right, this is a local police department, which means they get treated by the courts the same as a state agency. The Third Amendment hasn't been incorporated against the states. Is this an opportunity to revisit Slaughter-House (which the current court believes was wrongly decided), or are we stuck with another source of "Due Process"?
