OSS §21-374. Display of red flag or emblem of disloyalty or anarchy. Any person in this state, who shall carry or cause to be carried, or publicly display any red flag or other emblem or banner, indicating disloyalty to the Government of the United States or a belief in anarchy or other political doctrines or beliefs, whose objects are either the disruption or destruction of organized government, or the defiance of the laws of the United States or of the State of Oklahoma, shall be deemed guilty of a felony, and upon conviction shall be punished by imprisonment in the Penitentiary of the State of Oklahoma for a term not exceeding ten (10) years, or by a fine not exceeding One Thousand Dollars ($1,000.00) or by both such imprisonment and fine. Added by Laws 1919, c. 83, p. 133, § 1, emerg. eff. April 2, 1919. Amended by Laws 1997, c. 133, § 178, eff. July 1, 1999; Laws 1999, 1st Ex.Sess., c. 5, § 95, eff. July 1, 1999. NOTE: Laws 1998, 1st Ex.Sess., c. 2, § 23 amended the effective date of Laws 1997, c. 133, § 178 from July 1, 1998, to July 1, 1999.

Not a confederate flag fan, but the CSA has been defunct for oh, about 135 years. Just sayin...

Not that it matters because the courts will fill this full of lead and sink it.
Maybe, but it has been the law in Oklahoma for over a century according to the notes, most recently altered over 20 years ago. The courts have a tendency to defer to the legislature on such long-standing laws.

If any agency admin green lit enforcement of that statute they’d become legends.
I think they would also get hammered into the dirt on Constitutional grounds. The right to freedom of speech and expression. With the liberal bent affecting more and more of the US Justice system, these officials and the agencies they represent would have no chance in court.

Just because it’s a law doesn’t mean they can enforce it. There are some crazy, insane laws out there passed by cities/counties over the past couple centuries that would have a hard time enforcing nowadays. Thins like dancing in the street on a Sunday, or riding a horse eastbound on a thoroughfare on a Monday before daylight, etc.

This flag thing does kind of bother me. I mean, the whole freedom of speech thing and all. Who gets to say what is or isn’t anarchist of “anti government”? Is my Gadsden flag threatening to the “government”?
