Yes Officer - I walked inside and this guy came after me and my wife so I fired two shots - she ran outside and called you from the drive way.

If I get a call from the alarm company and you are in my house, you should hope that the police beat me there.

I find myself really torn there. While I agree is it worth the risk to me, I must also be a damn greedy SOB. I don't want anyone taking my stuff. Also, if this guy is doing this now, he has done it before and will no doubt do it again. The next time he may very well take a life. If my actions can prevent that shouldn't I act?

When you are my age you have "lost" so much stuff over the years you can't even remember if you ever really had anything.

While I cannot disagree with your logic about someone being emboldened by living through an encounter with me, I still think that if I have called the police and I, nor my loved ones, are in any imminent danger of harm or loss of life, then I have done all I need to do.

Yes there would certainly be a legal issue. In OK you cannot shoot a person thats not posing a threat to you or anybody else. That means if I were in your house with a gun and I saw you coming down the hall with a gun. I could turn and run for the door to escape. Should you shoot me in the back during this process you would be charged with murder or attempted murder. Also the fact that this guy went out of his way by going in the house knowing the perp was in there and armed he was looking for trouble. He could have walked next door out of harms way and called the popo. He did a ton of things wrong by OK law. He is lucky that he encountered some common sense cops that didnt charge him with anything.

Tx ( i hate to say this but) has the best HD and SD laws on the books . No other state gives a US citizen the options that TX does. Texans can shoot people over property .

You go home for lunch and there's a Ryder truck backed into your driveway. You pull in, blocking the truck in. A guy walks out of the house carrying your TV to the truck. According to Texas law, you can't just shoot him right then and there.

When somebody is trying to leave your house with your tv you can shoot them to stop them. They also have a "mischief after dark " law. Anytime somebody is breaking the law after dark such as vandalizing your property you can shoot them over that.

Only as a last resort.

You can shoot somebody thats breaking into your car in TX. We dont have laws that liberal here in OK. You will go to prison for shooting somebody breaking into your car here. You cant shoot somebody leaving your house with your property in tow unless they are posing a deadly threat. A little old woman couldnt do anything to stop an unarmed man from walking into her house and sacking it up. She just needs to hope that the cops get there quick enough.

Easiest gun fight to win is one you're not in. Agreed, in OK you do not HAVE to retreat, but why put yourself in a situation that could get you or someone else killed if you can avoid it?

I would have covered the rear of the house and had her cover the front to prevent his escape and called 911. If he fled and made the choice to escalate the situation with violence then the consequences would be his to deal with.

My personal opinion is if you illegally enter my house, you have a death wish. I guarantee if i shoot enough people breaking into my house, the majority of the criminal types out there will opt for an easier target.

My stuff might not be worth dying over, but my feeling of personal security and safety in my own home is.

+1. People seem to miss the first part of the OK statute that reads:

The Legislature hereby recognizes that the citizens of the State of Oklahoma have a right to expect absolute safety within their own homes.

If you stroll or drive up to your house, and see someone has unlawfully entered and is robbing you, you are not within your own home. Your safest and most legal option is to get the hell away from there.

I will definately shoot an intruder. If they break in while I'm there, or if I come home and discover them inside. Either way, they get the contents of my pocket protector.
