We lost our fence in a storm a few years ago. The neighbors behind us said that it was our fence and they wanted no part of replacing it. I have dogs and really need a privacy fence to keep their grand kid and my dogs separate. They then pitched a holy fit about us not displaying the "nice side" towards their house and threatened to sue me. We had to call the police when they threatened the fence builders for not putting the fence up like they wanted. Talking to their other neighbor I found out that they agreed to half the cost of their shared fence only to refuse to pay later. The only consolation I have is that these people are 80+ and I won't have to put up with them much longer. Their daughter is a lot more reasonable to deal with.

Ask him to pay you for your award winning Tibetan Mastiff that he released from your backyard when he took the fence down without warning you. I hear those dogs get pretty pricy, especially a good standing stud with good lineage.

Some people...

It's kind of an old game he played. He considered asking you first, but then what if you'd demanded a different fence than the one he wanted? You might have wanted a really cheapo fence or a really expensive fence. Or, you might have demanded that the fence not be replaced. Asking for your involvement could have sidetracked his whole fence project. So, he decided to do what he wanted and then just 'persuade' you to pay for his decisions after the fact.

He's got nerve. I'll give him that.

I've wondered why I have a back fence and the house directly behind me has their own back fence. They are about 6 inches apart. Just enough room where trees, weeds, etc... like to grow between them. I'm guessing people couldn't come to terms at one point.

I share my side fences with rental properties. Since the pickets are on my side, I replaced about a dozen of them this summer that were showing some age. I wouldn't even think about asking them to pay for half the cost.

If it's up to me, my next house will not share a fence. My neighbors have kids who love to throw balls against it, climb on it, shot arrows at it, etc... It's hot a huge deal, but it does age the fence a lot faster.
