Your buddy's insurance will probably pay the claim, than sue the U-haul driver to recoup their cost. I was T-boned 2 years ago by a tahoe, he ran a stop light. Totaled my truck, sent me to the hospital via the ambulance. Seems pretty clear who's at fault, one would think? Right. Wrong. Took over 3 months to get everything settled, with a lawyer. This is the reason I have Med-pay on all my vehicles now. Cost is additional $25/ year for $5,000 of coverage, just for injuries caused by or in /on your vehicle. Someone slams their hand in the door? They're covered. You hurt your back unloading some bags of cement, your covered. In a wreck and the other guys insurance has to low of a limit? your covered for at least an additional 5K. But you have to ask for it when buying your policy. Best stuff offered since AAA.

Go talk to my buddy J R Homsey in OKC on North Classen. He'll be able to tell you if you have a case, if he'll take it, or refer you to an attorney who will.

***Whom ever you go with, discuss their fees up-front. Know what you're getting into.....meaning the cost of the accident and your damages-vs- the cost of an attornies fees.*** Just look into this first. Tell your attorney EVERYTHING about the case/accident. DO NOT LIE to them, they work for you and are there to be legal council for you!!! They know what to state and how to state it in litigation.

I gotta say, if I was on the jury on this case in court, you wouldn't win. I'd imagine the alcohol had more to do with you hitting your head than the Uhaul driver.

He was doing nothing illegal or wrong. He would not have been injured if it wasn't for the U-Haul driver's error. Who is to say he would not have been injured if he hadn't been drinking....

Reasonable doubt in my mind. Was climbing out the window a better decision than climbing over the center console and out the driver door? Would he have been better able to make that decision sober? I don't see fault here on the uhaul driver.

Civil cases dont have anything to do with reasonable doubt. Their standard is by preponderance of evidence.

Telling the truth is always the best, no matter how it works out in the end for you. First of all, if you dont tell the truth and are sworn in when you testify you are committing purgery. Secondly and Most importantly it is a matter of integrity.
