they both said that I need to go to the ER, so she called EMSA and I went.

So hours after the accident, after you crawled in and out of the window, made another beer run, then you called an ambulance?

Me thinks this whole thing is a crock. Doesn't even make logical sense. Why didn't your buddy just take you to the ER? Or why didn't the RN or Corpsman take you?

If I was the insurance adjuster I'd have denied your claim too. Your story just grows more bizarre by the page....:explode:

Actually it was only about 30 minutes after the wreck. and my buddy that was driving was the Corpsman, and he offered to take me, but like I previously stated I did not want to go. Only ofter I noticed that I was bleeding out of my head, is when I decided that is was probably a good thing that I went

For real.

And for the amateur attorneys posting, the defendant's attorney is not going to be so stupid as to ignore the fact that plaintiff was drinking. That's where the injury originated, viz. from some drunk guy trying to crawl out the window of a vehicle.

If I'm called for jury duty for this case, I can guarantee he'll not see a dime.
It's a good thing you live in Tulsa he won't be seeing you in court anyway ! Because you Sir would be an in justice to the court system !

I don't know, I started this thread hoping that one of the lawyers on here would give me some advice on who can help me, but now everyone on OSA is a key-board attorney, saying that it is all my fault, if I wasn't drinking it wouldn't have happened. Saying that if they were the jury, or other insurance they would not pay anything.

I never said that I am trying to get rich off of this, I only want the medical bills taken care of.

And to the Mods. I think I have all the help that I need, can yall please close this thread.

Immaterial. If I were a juror, I'd know that crawling out the window of the damaged side of the car is something only a drunk would do. The fact that he got his foot tangled up in the seat belt only makes it funnier.

But you're right. He needs to go ahead and retain and attorney for this one. :D

BS! Ever hear of adrenaline? Drunk my a$$, if I'm abel, I'm out of the car. period. Thats instinct, alcohol, or not!

Amusingly, Westlaw's Headnote of the Day a few days ago is relevant here:

"A drunken man is as much entitled to a safe toilet as a sober one, and much more in need of it."
Cooper v. Nat'l R.R. Passenger Corp., 119 Cal. Rptr. 541 (Cal. Ct. App. 1975)

A drunken man is also entitled to safe passage on the highway, and the ability to exit his car.


(Another good headnote from the same case: "Whether an injured person's self-intoxication constituted contributory negligence is, ordinarily, a matter for the jury." For those of you who are willing to render judgment without hearing the full story, please stay away from jury boxes.)
