Irrelavent, OP was being responsible, and was not drinking and driving. Someone also commented he could have used the window. I am assuming the window was up, since its December/November. If door was damaged the point it wouldnt unlatch, not likely the window would roll down either.

Seriously dude, I would sell all of your guns, and NEVER leave the house again. Also if you have any power tools, get rid of them. Steak knives too. Hell, anything that can hurt you, get rid of it. I would go with plastic forks, and spoons, let a professional disconnect your garbage disposal. If you do leave the house, I suggest a thick lining of kevlar, and bubblewrap!

it certainly was not the originating factor in this case.

Immaterial. If I were a juror, I'd know that crawling out the window of the damaged side of the car is something only a drunk would do. The fact that he got his foot tangled up in the seat belt only makes it funnier.

But you're right. He needs to go ahead and retain and attorney for this one. :D

I never said it wasn't irrelevant. It's also very clear to...anyone...that it's a hypothetical question.

But it is a very similar situation. In fact, it's nearly exactly the same.

"I wouldn't have fallen down if you didn't stop me and ask me out of the car. I wasn't even driving."

I know hypothetical questions draw "FUUUUUUU what if guy!" from the internet at large, but that's often because people don't want to imagine switching parties in situations. JB knows that from the illegal discussions here. What's good for the illegal ain't good fer me. And it goes on to religion, class and all kinds of social groups. We see it every day here. This is another example. What's good for the Muslim don't apply to the Christian, what's good for the brown skinned person (profiling for illegals debate) ain't good for me.

Hey, I'm like everyone else. I base my opinion on things like this based on who is involved. I'll admit it though. Clearly the root cause must lie elsewhere. I've never seen a beer drinkin' redneck take a nose dive before. :D

I probably wouldn't get a lawyer. No more money than your talking about. Don't pay the bill and hammer on the insurance company. A lot or lawyers probably wouldn't even want to take the case.

Actually I hit the back side of my head. and after we got hit, I really did not want to go to the ER, after the OHP left, we got the car going, the fender punctured the tire, we got the spare put on, and was going back to the other buddies house, I did use the window to go in and out, the few stops we made, for air and another stop for beer. We get over to where we were going, and I got really light-headed and dizzy, and I saw the blood in my hair on the back of my head. My buddy that was driving the car is a Corpsman in the Navy, and my other buddy's old lady is a RN, and they both said that I need to go to the ER, so she called EMSA and I went.

And the reason I went out the window is because, after the impact the car was disabled in the exit ramp lane, we were only about 20-25 feet from the interstate, this was later at night so it was dark. I was in fear that we might get hit from behind so I wanted out of the car as fast as possible and the window was my best option for that.
