Is the property being used for the storage business zoned commercial?


If you want to take the opposite tack from slugslinger's message, a good lawyer could argue that cabbagebrain's willful negligence is damaging the road, which could be causing economic harm to the business and denying access to their property to the business's customers.

I've not read this entire thread but have read a decent amount.

Am I the only one who thinks its pretty crappy for the OP to want some lady to pay for part of the road that she doesnt use nearly as much as the OP? If it was 3 people using it residentially...their use would in general be equal. If I'm reading right, the OP has a storage unit business that also uses the road and thus would be causing a good amount of traffic on this road compared to the other users. I'd think you'd have an exponentially greater duty to maintain it than the other users.

I think you need to reread the OP. That's not what's happening at all. One of the residents on the street has taken remediation action on their driveway that is ruining the road for everyone. He just wants them to maintain their part properly.

I think you need to reread the OP. That's not what's happening at all. One of the residents on the street has taken remediation action on their driveway that is ruining the road for everyone. He just wants them to maintain their part properly.

Gotta read the whole thread. OP has an idiot neighbor that is moving earth causing water to washout his road.

In addition, from the OP's description, there isn't that much traffic to the storage facility. After all, people store stuff and seldom ever go to the storage unit because of that.

I think you're conflating the OP's story and Dennis's. Dennis's neighbor is the one who refuses to contribute to the maintenance of the shared road she also uses. The OP's neighbor is doing damage to the road, but while he might not be packing the gear to be called a man, he sure ain't a lady.

read the whole thread to clear things up. but short hand...i dont want anyone to pay me for anything, my business is tiny and they were using the road 10x more than my customers before i cut them off from my property, the last time i dropped thousands on fixing the road in gravel and equipment etc and they didnt offer to chip in at all (when they were using the road). I just want the neighbor to stop filling in the drainage ditches with dirt which causes water to jump up on the road and wash it out...I would even be willing to pay for a tin horn but he is an idiot and refuses.
