Negative. Case law in Oklahoma is that it can't cross the threshold of your doorway.

And if a good attorney wanted to stretch, he could apply "public" to you walking in front of a window with the interior of your home clearly visible from the street with a firearm.

+1 for in the home, not the yard right now.. but I seem to remember some case either here in Oklahoma or maybe it was a federal case that extended self defense to the front & back porch of the home so that it covered cases where the bad guy was in the process of forcing their way through the door with a weapon or was shot coming through the door and then fell outside the house. It use to be that the difference between where the bad guy fell [inside or outside] meant the difference between self defense or a manslaughter charge.

Remember the old jokes about having to drag the bad guy inside if you shot him.. that is where that came from...

All of this knee-jerking is based on hysterics, even though some of it has been fueled by LEOs own comments regarding what they will do if they see someone open carrying. I predict that this will be short lived, because they have actual crime to prevent/respond to, instead of harassing law abiding citizens, and responding to silly calls from citizens that have nothing better to do. Plus, if this becomes too much of an issue, some heat will be applied to LEOs to stop the nonsense
I have not seen or heard any Oklahoma LEO making statements that they would attempt to undermine this if it becomes Law. I have seen it in other States but not ours. Are you aware of any Oklahoma LEO's that have implied that they will intentionally make it hard on citizens who are following the law?

I just sent a e-mail to the governor's office asking if there was gong to be a signing ceremony for SB1733 and if so, would they let me know when so I could try and attend. This is a milestone in Oklahoma law. If they let me know anything I'll post it. If you want to send a similar message, here is the link..

I have not seen or heard any Oklahoma LEO making statements that they would attempt to undermine this if it becomes Law. I have seen it in other States but not ours. Are you aware of any Oklahoma LEO's that have implied that they will intentionally make it hard on citizens who are following the law?

During 2011 legislative session when OC was up to become law one of our OSA LEO members stated that he would make it his policy in his town to hassle anyone who he saw OC'ng and he could care less what the law said. He was called on that by not a few OSA members. The thread disappeared after 3 or 4 days of the start date and is no longer available for view. I'm sure that some here remember that thread and others that posted in it.

So - based on that one thread I would say that - yes - there may be some police officers that "may intentionally make it hard on citizens who are following the law".

I don't think I said in your yard, I said at home, which in my feeble mind means in your house.

Many people equate "at home" with "on the property where my dwelling sits".

But the second part of what I said still applies. It's why someone who is seen walking past a sheer-curtained window nude assuming no one can see them ends up being convicted of a "sex crime" and registered as a "sex offender", or why if someone sees something illegal through your window there is no warrant necessary, all because of the notion of "in public view".

Well put.


The main purpose of the CWL is to allow citizens, properly licensed, to carry a gun on property that they don't control. You could always carry a gun at home.

We should all remember that Oklahoma is not the first state to allow open carry. Oklahoma is one of the last eight states to allow some form of open carry. So the impact of allowing open carry is well known, and the impact is negligible. It is a non event in states which allow open carry. Why should it be any different here.

The anti gun crowd and the fraidy cat politicians like to say that blood will run in the streets and folks will die. Some law enforcement officials, for their own reasons, will whine, but it will become law and they will have to deal with it.

Just remember that it is up to us to protect ourselves and our loved ones. As a Dallas PD officer, I always got to the scene after the action was over and someone was lying on the floor dead. No matter how diligently law enforcement performs their duties, they are always there after the deed is done. Some law enforcement officials fail to recognize that fact.

The ability to carry a handgun and protect ourselves and our loved ones has reduced violent crime in every state that has returned that Second Amendment right to the general public. Why won't blood run in the streets? Because only responsible citizens of Oklahoma go to the trouble and expense of getting a CWL and those folks act appropriately in the whole.

Finally, I take the Governor at her word and fully believe that she will sign the bill into law this week. I don't think she will veto it or even allow it to become law by just waiting for the five days to pass. I don't think she is waiting to hear from the anti gun crowd because she knows she will hear from them anyway. She stated she would sign an open carry bill before she became Governor and has said the same on other occasions. So just believe.
