From reading the motion to dismiss, this could get interesting. It sounds like a textbook case of self defense from reading the defense's motion. That's not surprising as it's only one side of the story.
From what I have seen, it is his only defense.
What's the evidence against his claim of self defense?

The stretch of road where this happened was a weird spot for road rage to occur. I know that has no bearing on anything but a quiet West Norman street does not seem like the sort of place I'd end up in an argument and eventual shooting.
It’s only a textbook case of self defense if one ignores the fact that Kottka got out of his vehicle, in the middle of the road, to confront the deceased.
Nothing in his motion indicates the deceased entered, or attempted to enter, Kottka’s vehicle. That should be relevant…
