Yep... First step is to start documenting the damage and the cattle on your land. Pictures, dates, times, etc... It shouldn't be hard to find the owner or the leasee thru your county.

Then start calling the sheriff. Might try the state brand inspector, too (if they have those here...don't know).

Also if you dont have the means or the facility to feed and keep them penned the sheriff can get into contact with someone that can come a get them for you and hold til damages and upkeep is paid and if no ones shows then they can be auctioned off and you and whoever gets the proceeds to cover your expenses

just put up a good high tensile electric fence just inside your fence. they won't come again and you will save yourself the cost and trouble of legal. now for a sure fire way and if the cows are someones nice herd just get yourself the raunchiest jersey bull you can find. that bull will breed every one of his cows and heifers and come calving time and the scrawny jersey calves start popping he will fix the fence and tell you to keep your bull on your side.

It is my understanding that Oklahoma is a "Fence In" State, whereas New Mexico and other Western States are "Fence Out" States. Which means that in Oklahoma it is the responsibility of the cattle owner to maintain proper fences. In States such New Mexico, Montana, Wyoming and such, it is the responsibility of a land owner to erect fences to keep cattle out if you don't want them on your land.
