Unrelated. The homeowner wasn't bound by contract with South Fulton.

When he said he would pay all related expenses, that was initiating a verbal contract. If South Fulton would have agreed then that would have constituted a contract. The fact that it's across state lines has no bearing. Again, the only issue would be that it was a verbal contract, (unlike your home loan which is a written contract).

For those who think that the department should have gone ahead and fought the fire because the homeowner agreed to pay "whatever the cost" on the 911 call, that "agreement" is not as sound as one might think.

Sure, it could easily be construed as a verbal agreement with the fire department to provide services, and thereby obligating the fire department to fight the fire. However, when it comes time to collect the bill, the homeowner's attorney will be able to claim economic duress because there was not a viable alternative party to enter into an agreement with at that time.

I must have missed it in the 19 pages of BS. It would have been a verbal contract. The legitimacy of it may be difficult to discern, i.e. was there actually an agreement, was he under duress, etc., but there would have been a contract. The fact that it was across state lines has no bearing despite how many times you keep bringing it up.

Those of you who believe that they should have just stood by and did nothing are all A$$HOLES.

BTW.. I say this as a volunteer Firefighter who belongs to an all-volunteer Dept.

Were they alive when the firefighters arrived?


How the hell would they know? The never got off of their collective A$$ES and surveyed the scene. They stayed in the their vehicles and waited until the fire encroached the neighbor's property. Then they got out and put oout the fire as it crossed the property line.
