Article 6, Clause 2, the Supremacy Clause: States are bound by federal treaties and laws (that are not struck down as unconstitutional by the Supreme Court). Makes for good political speeches, though.

True, but it sure as hell sends a message to Washington, though. Maybe when all the freedom loving states pass bills similar to this Obama will take notice that we don't plan on complying with any UN regulations or senseless bans.

HOUSE BILL 3157 By: Osborn





AS INTRODUCED

An Act relating to crimes and punishments; amending 21 O.S. 2001, Section 1289.2, which relates to the Oklahoma Firearms Act of 1971; providing legislative findings on firearm registration and confiscation; and providing an effective date.





BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 21 O.S. 2001, Section 1289.2, is amended to read as follows:
Section 1289.2
LEGISLATIVE FINDINGS FOR FIREARMS ACT
The Legislature finds as a matter of public policy and fact that it is necessary for the safe and lawful use of firearms to curb and prevent crime wherein weapons are used by enacting legislation having the purpose of controlling the use of firearms, and of prevention of their use, without unnecessarily denying their lawful use in defense of life, home and property, and their use by the United States or state military organizations and as may otherwise be provided by law, including their use and transportation for lawful purposes.
The Legislature further finds that the citizens of Oklahoma shall not be required to participate in any international, state or federal firearms registration program nor shall any firearm lawfully owned and possessed by a citizen of this state be subject to confiscation unless such firearm has been used for unlawful purposes in violation of the Oklahoma Statutes.
SECTION 2. This act shall become effective November 1, 2010.

And according to tradition, but not specifically the constitution, the Supreme Court gets to say what the constitution means. They have not yet said that the second amendment applies to the states. They're supposed to tell us about that in June.

It applies to "the people"

As far as federal power is concerned. That's the point of the present lawsuit. All they determined in the DC suit is that the 2nd amendment is an individual right as far as federal law is concerned. The lawsuit regarding the Chicago gun ban is testing whether the constitution protects that right to the same degree from regulation by the states. Not every one of the bill of rights has been applied to the states through the 14th amendment. The 5th amendment, for example, is an individual right that states do not have to provide to you but the federal government does.
