How wise is it to drive without headlights...

I'd have to say that the guy illegally riding a dirt bike without a headlight or helmet, who smelled of alcohol was probably responsible for his own death. LE can and do operate without headlights as necessary to detect crime and apprehend criminals in the act. It's no different than hitting an animal or any other road obstruction. Don't operate your vehicle in such a manner that you can't avoid roadway obstructions in your path.

Besides, the bike rider wasn't even in the proper lane, according to the report.

C. 1. Pursuant to the provisions of this subsection, a game warden may operate a vehicle owned or leased by the Department upon a roadway during the hours of darkness without lighted headlamps, clearance lamps, or other illuminating devices. As used in this paragraph, "roadway" shall include any street or highway in this state except an interstate highway, a limited access highway, a state trunk highway, or any street or highway within the limits of an incorporated area.

I don't get it. The game warden was driving blacked out in the performance of his duties as allowed by the state, and the fellow on the bike had no headlight and was on the wrong side of the road. Even with no lane dividers, it's not hard to stay on the proper side if you're paying attention unless it's pitch black out, in which case why would you be riding an ATV?

What's the problem?

I don't see how a game warden, fully in the scope of the law, driving on the proper side of the road is at fault. Guy riding dirtbike in the dark with no headlight obviously wasn't the brightest guy in his class.

indangering the public while driving without his headlight on. If he recieved a call and had reason to approach with out the lights on I could understand but the report never stated that. So your telling me that Law enforcement can break the law by driving without headlights on a moving car just because that want to?
