Ever walked through a Technology school bud? Seen those welders, torches, lathes, car lifts? I guess you have those teenagers hurt constantly around all that stuff, "it just takes one incident for this to turn horribly wrong"

Is there any legislation concerning LE harassing citizens while open carrying? It may be referred to as "preemption".
I have been following several instances of LE attempting to use various excuses to keep citizens from exercising open carry rights, and the cities paying out settlements.

You mean presumption or probable cause. Preemption refers to state statutes being the final say in the matter in Oklahoma.

Under SB129, it would be presumed that you are carrying a firearm legally if you're carrying openly and appear 18 or over.

Under HB1647, it would be presumed that you are unlawfully carrying a firearm if you carry it in the open no matter what your age.

HB1796 is dead.

SB129 is the only open carry bill alive. It is now in the House Public Safety Committee on a date with Ms. Tibbs.

HB1647 passed the House with an amendment that modifies the "reasonable fear" defense against unlawful carry to also require a protective order.

And, oh yeah, the Republicans also passed a bill to start implementing Obamacare.

At least one good thing to come out of Thursday was passage of the ballot access bill.

Some of both. Preemption, so cities and counties don't create a patchwork of open carry areas and probable cause. If sb129 were to pass as written, can an LE detain you, take your weapon, ask for ID, run you through the system for, say sitting in a restaurant while open carrying. That will quash most people from carrying if they anticipate an hour of theater with local law enforcement every-time they are in certain municipalities, even if they are not writing disorderly conduct and disturbing the peace citations.

As written, SB129 presumes that a person is legally carrying a firearm if they are carrying it openly in a holster and appear 18 or over, just like if you are carrying a firearm while hunting.

That means that openly carrying a firearm pursuant to that measure could not be used as probable cause for detainment and/or processing. Would an officer try? I'm sure there are some. But from what I know, the threat of a lawsuit for misconduct versus the loss of a job for whoever authorized or encouraged such action tends to result in the department leaning toward cutting a job or two as an at-will employer or under another part of their union contract.

If I was so inclined, I would be finding my post from over a year ago when Sullivan was pulling all that shady county law enforcement crap without really telling everyone what it was about (i.e. doing an end-around city government), where I pointed out that a guy who will do shady stuff to pass issues that you support (as many here did) will also pull shady stuff on issues that you disagree with.

We have not met but I knew Dan and his previous wife casually and she at the time was more involved in politics than he was as a behind the sceens consertative supporter.When I saw that Sullivan was against Rex Duncan's bill that passed through the last session on open carry I was surprised since I knew him as a gun owner and permit holder and even went through a tactical course with him. I have since began to view him as a snake and if you become so inclined, I would like to read your mentioned post.I do think we have a mutual friend, Steve Scoggin.
If you have any suggestions on how to proceed I would like to hear from you. If you want to send as a PM that will be fine if you don't want your reply public or if you want it to be ,shall we say ...more frank.

OK2A is planning a gathering at the Capitol. It's still being discussed as far as a date but I'll let you know when I find out. They are still supporting 1647 with the hope that (and it's a good possibility) the language will be completely changed in the senate and passed back to the house (where it already passed) for another vote to see if all those who voted yes will still support 2A or flip flop.
It's a game now.
