I think it can and should!

The right of free speech protects folks from governmental prosecution. The 1st amendment protects individuals from the government not companies, organizations, communities, or peers.

Couldn't the argument be made that Facebook simply reflects the person posting to it?

If you get fired for the dumb crap you stick on FB, it is fair to say that YOU are being fired, not your Facebook page.

Chances are the dumb crap comes out of your mouth whether it's posted to FB or not. You might be the type to get fired/arrested/have your teeth kicked in without it, so why play the victim?

I don't have any of my co-workers as friends. My boss won't accept any friend requests from co-workers either. If I go to a job interview and they want to see my FB page, the answer is "no" and look for a different job. My opinions on politics and religion are my own and as long as I don't slander the place I work for, it's none of my employer's business.
