A bill that would exempt guns and ammunition manufactured in the state of Oklahoma from federal regulations has cleared a House committee.

The House States' Rights Committee voted 8-3 on Tuesday for the "Oklahoma Firearms Sales and Manufacturing Initiative" by Arcadia Republican state Representative Lewis Moore.

The bill makes it illegal for any federal employee or agent to enforce any U.S. regulations on firearms, firearm accessories or ammunition that is manufactured in Oklahoma and remains within the state's borders.

The bill does not apply to firearms that take more than one person to operate or ammunition with exploding projectiles.

The bill also prohibits physicians from documenting information about a patient's gun ownership.




Does this mean new select fire guns and suppressors and all of those goodies can be made for us by us without any pesky forms?

I suspect it will be the same as the attempt to pass this legislation last year and will not include select fire weapons. However, it would encompass sbr, sbs, supressors, etc.

The feds will still be able to touch it via the Commerce Clause. The same argument in Gonzales v. Raich, 545 U.S. 1 (2005) applies here. By choosing to not enter interstate commerce while in compliance with state and local laws, your actions have an effect on interstate commerce and are thus still subject to federal regulation.

Yep, its a feel good legislation for the most part. Just puts the congress on alert that some states don't agree with what they are doing, like they really care what we think.

But, we WILL vote for the person that introduced it.

The Feds would still attempt to enforce the national gun laws here in Oklahoma even if it passed, and the Supreme Court would back them up. Same situation as with all the states legalizing marijuana... it's not prohibited on the state level, and state LE won't do anything about it, but the Feds can and will.

This type of law is basically just a big FU to the National government and the ATF... which I wholeheartedly support!
