My reply

So you took it upon yourself to pick out a fence and replace it expecting me to pay for half. Even if the existing fence was fine for my needs. Further, you decided that you deserved the "pretty side" of the fence while you expected me to pay the same amount for the ugly back side.

No, I don't think I owe you any money. And I think I'll drop my pants and show you my ugly back side!

A good moon should end the conversation!

It's pretty common for neighbors to split the cost of a new fence...however, he absolutely should have discussed everything with you first. How do you know he didn't use his buddy's company to install the fence and they agreed to do it for parts and your half of the labor???

Valid (Smartass) responses:

3) I am removing my half and placing it in the from yard.

I second # 3, I like it.

Is it not customary that when splitting he cost, the one who gets the flat side pays 60%, and the post side 40%? My neighbor down a few houses told me the one who has the flat side pays for the fence, that's the first I ever heard about that one, well, I also only heard about the 60/40 thing once as well. I would think there would be some sort of city ordinance on this issue.

The rule of thumb is, whoever has the good side owns the fence. I personally would give myself the side with poles or panel both sides just because I don't like for my fence to be climbable from the neighbors yard.

But if you have the good side it's yours.

In your case. You are not responsible for any of the cost because it wasn't discussed with you. Some people can't afford the cedar and will agree to the cheaper white wood fencing, or only paying for half of a white wood fence and the neighbor wanting cedar pays for the difference. Or steel posts over wood posts.

He's probably on a fence forum whinin' about how you're gougin' him.

LOL! You're probably right. :)

This sounds like the type of guy who would sneak a property lien on your property since he didn't get his way.

Let's hope not. That's kind of why I'm interested in what the law says about it too. At the end of the day, I don't give it much thought beyond a good laugh but if he tries to pull something like that, then it all of a sudden becomes real and I have to actually deal with it.

The funny thing is I had the good side before and he installed this one with the good side towards me as well. He did use still posts and cedar so big up-charges on all of it.

I guess I should have looked at his paperwork to even see how much he was planning on charging me. I'm kind of curious now and would also like to know if he bothered talking to the neighbors on either side of him ahead of time too.
