How do you prepare for a discharge petition, in order to get sb129 out of the House committee? Is the petition circulated by rep or can one of us subjects do it?

From WIKI (I know, not the best reference)
"The modern discharge petition requires the signature of an absolute majority of House members (218 members)".

Can anyone explain to me why it is so hard to pass a bill that would read similar to:

Anyone in the State of Oklahoma 18 years old or older, who may legally possess a handgun, may carry said handgun in a way that is openly visible to the public, except (where it tis illegal to do so, i.e. bars, government offices, professional sporting events, etc.).

Anyone who carries a handgun concealed from view must comply with the provisions of the Oklahoma Self Defense Act.

There's not enough specifics and too much left open to interpretation.

But what's so hard to understand about SB129:

"A person shall be permitted to carry loaded and unloaded shotguns, rifles and pistols, open and not concealed and without a handgun license as authorized by the Oklahoma Self-Defense Act...When carried in a holster that is wholly or partially visible or in a scabbard, case or with a sling designed for carrying firearms that is wholly or partially visible and the person is eighteen (18) years of age or older. Any person who carries a firearm in the manner provided for in this paragraph shall be prohibited from carrying the firearm into any of the places prescribed in subsection A of Section 1277 of this title[.]"

Is this an accepted practice? Just tossing the entire content of a bill and swapping in something else? Why not just introduce a new bill? Is the language about suppressors on private property then shunted to the round file?

Bills must be introduced at the beginning of the session. After that, the only way to "introduce" a new bill is through the amendment process. That's also why you see so many placeholder bills introduced at the beginning of the session that contain virtually no language.

That was the biggest joke of the day. They pass a holiday to honor a supreme court descision that defines the individual right to bear arms, but when the actuall bill addressing said right comes up they hemm and haw blatantly ignoring that current Oklahoma law is in violation of that exact decision and the very amendment they named it after.

Every day I am reminded just how many truly incompetent people there are in the world.

And the best part is, the second amendment isn't even in hard to understand-ese. "The right of the people to keep and bear arms shall not be infringed." now since the supreme court, in that decision, recognized the RKBA as an individual right, not just applying to a militia, then by law that means the second amendment is to be interpreted thus- "the right of the individual to keep and bear arms shall not be infringed."

Technically, the SCOTUS said that the Second Amendment only protects the right to possess a firearm for purposes of self defense within the home. Heller and McDonald are good reads.

How do you prepare for a discharge petition, in order to get sb129 out of the House committee? Is the petition circulated by rep or can one of us subjects do it?

I believe a Rep has to officially start it (not sure), but it can be circulated by lobbyists and individuals.

When I was at the State House last week, my rep told me that during the last two weeks of the session, they can take some bill that is out of committee, remove all the content and add entirely new content. Perhaps someone will have the gonads to give us something other than Second Amendment Day.

I think you're getting a discharge petition confused with an initiative petition. An initiative petition is a public petition to get a measure on the ballot, whether it be a statute or a Constitutional amendment. An initiative petition is circulated among the public and requires 51,739 valid signatures (meaning you need at least 100K to be "safe").

A discharge petition is a petition among the House of Representatives to forcefully discharge a bill from committee. This is how HB1647 got to the floor. Tibbs wouldn't let it out, so OK2A and some other so-called "open carry" activists circulated the discharge petition at the Capitol. (I note the "open carry" part because they were making little, if any, mention of the lifetime permits for veterans.) Upon receiving 68 signatures, the bill is discharged from committee and placed on the General Calendar. It bypasses the committee chair and House leadership.

An initiative petition bypasses the legislature altogether.

You can kiss the open carry bill good bye. Some other lawmaker injected a clause that only applies to restraining order applicant, how that clause was injected blows my mind, now the bill with the new clause comes to the senate for vote. Hope the cluase gets change at the senate or else the open carry bill will never see the light of day. Wow just imagine all our tax money to pay for all these lawmakers to argue about my rights to bear arms. Everything boils down to "Rights is not what you have but what is allowed you to", funny since this country is founded by bearing arms against tyrany of england. :scratch:
