This really should happen. They couldn't win, but they could keep the issue in the news.

Verizon customers, all telephone customers, can't sue because Congress made this whole thing legal, though they feign ignorance of the law now.
The bill also granted immunity to phone companies that gave customer records before the law made it legal.
