Agreed, but unfortunately the charge has to be made during a time of declared war. The last time war was officially declared by Congress was in WWII.

No need for congressional approval.
I honestly think the congress should make police actions illegal by law unless approved by a 2/3 majority of congress, but that is a pipe dream and will never happen.
The weapons manufacturing community funnels too many perks to congressional members for that to ever come to a vote.
