I sent what you posted to my tax lady to get her take. Here it is

"My question is, has this guy read up on how they are requiring the people who receive a 1099k to report that? He says not a reportable event, but I can promise If we don't include it on the tax return, the IRS will come back and add it to your return, and send you a bill. So I am going to have to figure out how to show it as received and then given away to be sure you aren't taxed.

This is a new thing for 2023, there hasn't been much guidance even given to us that are current and up to date on tax laws, let alone anyone else. So I am not sure that "old tax guy" really is aware of the change that they haven't even made a decision on how to handle completely. However, if he has some kind of knowledge or information on how this will be handled, I would love to know where to find it.'
I know the reporting requirements are causing lots of problems. Luckily I am retired and don’t have to deal with the mess. I always believed in reporting transactions to reflect the true nature of the transaction. In this case, the true nature of the transaction doesn’t involve an income tax issue and doesn’t belong on an income tax return. It is a gift tax issue and is too small to require reporting. I would not report the transaction on an income tax return and answer IRS questions later, if they come. This being said, I am basing my answers on my past experiences after 40 years of tax practice. I was an IRS agent for a few years, so, in practice, I never shied away from arguing with them over any tax issues. As I said, I am retired and admittedly haven’t felt the need to keep up with the reporting requirements. My reasoning is technically sound and would argue otherwise with anyone. Feel free to ignore my comments and play Uncle Sammy’s game.

Thanks for the info and your background. What is the deal with the IRS purchasing millions of rounds of ammo?

Wife wants the paint job. She says that she is a former OSU grad.

Maybe I misunderstood (after-all I'm not always the brightest one in the room 😂) but how does one become a former OSU grad? Do they, like take the diploma back?
