Probably because it would be a waste of resources when it will easily be overturned would be my guess. This is low hanging fruit for the new folks coming to the fight to get their name out there.
It depends on how NM ended QI. As fabricated by the SCOTUS, QI can protect all gov't bad actors, but if the means used to end it in NM only ended it for the po-po, it could still be intact for politicrits and bureaucrats. Maybe I'm a cynic, but I don't see politicrits ending anything that protects them.
